A Growing Push to Restrict No-Fault Divorce Could Hurt Women’s Autonomy

Across the U.S., there is a growing push to restrict or eliminate no-fault divorce at the state level. This law (a legal norm in all 50 states) allows couples to end a marriage without proving wrongdoing. Restricting it could make marriage harder to exit, potentially trapping people, especially women, in abusive or unsafe relationships due to increased legal hurdles and the need to prove “fault.”
